Terms of Service

These Terms govern how businesses access and use PepeaDuka, including our 7-day trial, paid packages, onboarding support, billing, and cloud point-of-sale tools.

1. Acceptance

By requesting a trial, creating an account, using PepeaDuka, or paying for a package, you agree to these Terms and our Privacy Policy. If you are using the service for a business, you confirm that you have authority to act for that business.

2. Service scope

PepeaDuka provides cloud software for everyday business operations, including point-of-sale, receipts, inventory, customer records, user management, reporting, activation workflows, and related support features.

Some features may depend on internet access, supported devices, third-party providers, or the package you purchase. We may improve, update, replace, or retire features as the product evolves.

3. Trial and paid packages

PepeaDuka offers a 7-day trial for approved businesses. Trial access may include onboarding guidance, feature limits, or queue-based activation. Trial access does not guarantee permanent free use.

To continue after the trial, your business must move to an available paid package. We may end, shorten, or suspend a trial if misuse, fraud, false details, or operational risk is detected.

4. Account responsibilities

You must provide accurate account, billing, and business information and keep it current. You are responsible for your users, passwords, device access, and activity carried out through your account.

You must use the service lawfully and only for genuine business operations. You may not interfere with the platform, attempt to bypass security, reverse engineer the service, or use PepeaDuka to store or process unlawful material.

5. Fees and billing

Paid subscriptions are billed according to the package and cycle you choose. Unless stated otherwise, fees are due in advance and are non-refundable once the billing period starts, except where law requires otherwise or we confirm a refund in writing.

You are responsible for taxes, mobile-money charges, bank charges, and any applicable transaction costs tied to your use of third-party payment services.

6. Customer data

You retain responsibility for the business, customer, order, and stock data you enter into PepeaDuka. You confirm that you have the rights and permissions needed to use that data in the service.

PepeaDuka may access and process that data as needed to operate, secure, support, back up, troubleshoot, and improve the service in line with these Terms and our Privacy Policy.

7. Third-party services

Some functions may rely on third parties such as payment processors, messaging providers, hosting infrastructure, analytics, or communication channels. Their outages, pricing, compliance rules, or service changes may affect how PepeaDuka operates. Your use of those third-party services may also be subject to their own terms.

8. Suspension and termination

We may suspend or terminate access where there is non-payment, security risk, platform abuse, legal risk, or material breach of these Terms. You may stop using the service at any time, but subscription fees already due remain payable.

After termination, access to your data may be limited and we may delete data after a reasonable retention period or where required for legal, backup, or security reasons.

9. Warranty and liability limits

We work to keep PepeaDuka available, secure, and useful, but the service is provided on an "as available" basis. We do not promise uninterrupted operation or that the service will be error-free in every circumstance.

To the extent allowed by law, PepeaDuka is not liable for indirect loss, lost profits, lost business opportunity, or loss caused by misuse, device failure, third-party outages, or customer error. Our total liability for a claim relating to a paid subscription will not exceed the fees paid to PepeaDuka for the affected service during the 12 months before the claim. For trial-only use, liability is limited to a reasonable nominal amount allowed by law.

10. Governing law and updates

These Terms are governed by the laws of Kenya unless mandatory law requires otherwise. We may update these Terms from time to time. When we do, we will post the updated version here with a new effective date. Continued use after the update means you accept the revised Terms.
